Protecting your privacy is an important issue to Now Finance Limited. We recognise that personal information you provide, in order for us to perform our service to you, needs to remain correct and secure from disclosure so that your rights are protected. This policy is designed to detail to you why we need the information we request, what we do (and promise never to do) with that information, and the security we provide to ensure your privacy is protected.

What is Personal and Sensitive Information?

Personal Information, as outlined in the National Privacy Principles, is information that can identify you. This can be explicit identification, such as your name, or merely information from which your identity can be established, such as your address or bank account number.

In providing our investment services to you it is likely that we will require this information. The use of this Personal Information will be limited to the Primary purpose – providing our services – and possibly the related secondary purpose of corresponding with you in order to inform you of relevant goods and services we believe may be of interest.

Any secondary use of your Personal Information would only come from within Now Finance Limited. Now Finance Limited promises never to disclose (give, sell, or rent) personal information to any other organisation for their marketing purposes.

Sensitive Information is defined as an individual’s private preferences and opinions, their race, their religion, or private medical issues. In almost all cases, this information is not relevant to Now Finance Limited or the activities we undertake on your behalf. It is likely that such information may be collected inadvertently by our company – if the sensitive information is not relevant then it will not be recorded. If it is relevant, then it will be recorded only in so much as is required to perform our duties better for you with that information in mind. For example, one of our directors meets with Investors A and B. Investor A is of South American origin, but since his ethnicity is of no relevance to the service provide by us there is no need to record that information. At the same time, Investor B discloses that she has a serious problem with her sight, and that she requires all correspondence to be sent by mail in a large font size. In order for us to best serve Investor B, that information is recorded.

How is my Personal Information stored and used?

As a rule, Personal Information is required from Now Finance Limited’s clients or potential clients. This information is used for several purposes.

Primary Purpose

Primarily, your Personal Information is used to allow us to provide our service to you. This information will be used accordingly: for example, your bank account details may be needed to transfer a dividend payment to you; your e-mail address may be used to update you on information related to your investment.

Secondary Purposes

There are a range of secondary purposes that your information may be used for, each of which is related to the Primary Purpose.

One such use is Feedback and Market Research. From time to time we may contact our clients to find out how we might be able to improve our service to them.

We may also use the information for direct marketing purposes and to seek potential clients through promotional activities. This may be in the form of letters, e-mails, telephone calls, or reports on our activities. In providing your information you agree to this use, and you may ask to be removed at any time.

How is Personal Information stored?

The Personal Information that we collect may be stored in different media. As a general rule, the information will first be noted in hard copy on paper, and any relevant information will later be transferred to a centralised computer database. This enables Now Finance Limited to efficiently provide our service to clients and potential clients, and also offers a deal of security to our clients and their information.

This information is as secure as our computer network, and Now Finance Limited has spent a great deal of time and money ensuring that security. In addition to the centralised database, accessible only by relevant parties within our organisation, your information is securely backed-up frequently to prevent against loss.

Who has access to my information?

Now Finance Limited has no intention of disclosing the personal information of our clients without necessary reason to do so, and pledges not to share such information with any unrelated third parties or other organisations.

In order for us to provide our services, however, it is often necessary for some of that information to be shared. For example, your name may be provided to our legal team as part of a list of shareholders. These organisations may include, but are not necessarily limited to your advisor, accountants, auditors, banks, government agencies, insurers, service providers (including property developers), and solicitors. Failure to provide us with the required personal information may result in us being unable to provide a service to you.

Personal information is only provided to those organisations when it is necessary to enable us to provide our services or to comply with our legal obligations.

What are my Rights?

Your rights are detailed in accordance with the Privacy Act and guiding Privacy Principles. You have the right to request a copy of all your Personal and Sensitive Information we may have stored. You have the right to request details about which other companies your information may have been provided to, and the reasons why it was disclosed. You have the right to correct any information we have stored that may be incorrect. And you have the right, if you are receiving information from us, to discontinue that service.

Whenever it is possible, we will remove some or all of your information at your request. Please note that requests for your personal information can only be made by you.
